1. Agreement

By submitting an enquiry, making a booking, or providing payment, you (“Client”) acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions with [Your Business Name] (“Photographer”).

These Terms constitute the entire agreement between the Client and the Photographer and supersede all prior communications or understandings.


2. Booking & Payment

A booking is confirmed only once a deposit or full payment has been received.

The remaining balance must be paid prior to or on the day of the session unless otherwise agreed in writing.

All payments are non-refundable except where required under the Australian Consumer Law.

Prices are subject to change until a booking is confirmed.


3. Cancellations & Rescheduling

A non-refundable deposit is required to secure all bookings.

Cancellations with at least 48 hours’ notice may transfer the deposit to a future booking (one-time transfer, subject to availability).

Cancellations within 48 hours, or failure to attend, will result in forfeiture of all payments made.

Repeated rescheduling requests may result in cancellation without refund.

If the Photographer is unable to attend due to illness, emergency, or unforeseen circumstances:

A rescheduled date will be offered; or

A full refund will be provided if rescheduling is not possible.


4. Late Arrivals

Late arrival will reduce the session time accordingly.

Sessions will not be extended beyond the agreed time.

If the Client is more than [15–30] minutes late without notice, the session may be cancelled and treated as a no-show.


5. Session Conduct, Safety & Refusal of Service

The Client is responsible for their own safety and the safety of all participants.

The Client is responsible for ensuring all participants have consented to be photographed and are legally able to do so.

The Photographer reserves the right to refuse, stop, or terminate a session where:

Conditions are unsafe

Behaviour is inappropriate

Circumstances fall outside agreed expectations

The situation poses a risk to safety, wellbeing, or professional standards

No refunds will be provided where services are terminated under this clause.


6. Location & Permissions

The Client is responsible for obtaining any necessary permissions, permits, or approvals for locations, venues, or participants unless otherwise agreed in writing.

The Photographer is not liable for any issues arising from failure to obtain such permissions.


7. Creative Control & No Guarantee of Outcomes

The Photographer retains full creative control over all aspects of the session, including lighting, composition, posing, and final image selection.

The Client acknowledges that photography is a creative service and that results are subjective.

While reasonable efforts will be made to meet expectations, no specific outcome, pose, expression, or aesthetic result is guaranteed.


8. Image Delivery

Final edited images will be delivered within a reasonable timeframe (typically [X–X] weeks).

Delivery timeframes may vary depending on workload, season, and shoot complexity.

The number of images delivered is determined by the Photographer based on quality and consistency and in accordance with the selected package.


9. Editing Style

Images are edited in the Photographer’s signature style.

By booking, the Client acknowledges and accepts this style.

Requests for re-editing or alterations outside this style are not guaranteed.

Additional retouching may incur extra fees and is at the Photographer’s discretion.


10. RAW Files

Unedited RAW files are not provided under any circumstances.


11. Copyright & Ownership

All images remain the intellectual property of the Photographer and are protected under the Copyright Act 1968.


12. Licence & Client Use

The Client is granted a non-exclusive, non-transferable licence for personal use only.

Personal use includes social media sharing and personal printing.

The Client must not:

Edit, alter, or apply filters to images

Sell or commercially use images

Provide images to third parties for business use

Any use for business, promotional, advertising, branding, publication, or financial gain is considered commercial use and requires prior written permission and a separate licensing agreement.


13. Third-Party Interference

The Photographer is not responsible for compromised coverage or missed content due to interference from third parties, including venue restrictions, members of the public, weather conditions, or other photographers.


14. Privacy & Image Use

Client privacy is respected at all times.

Images will only be used for portfolio, website, or marketing purposes with prior Client consent. Consent may be withdrawn for future use at any time, subject to practical limitations.


15. File Storage & Client Responsibility

Final images are stored for a limited period (minimum [30–90] days unless otherwise stated).

Upon delivery, the Client is solely responsible for downloading and securely backing up all files.

The Photographer is not responsible for loss of files after delivery or after the storage period has expired.


16. File Integrity & Technical Issues

While all reasonable care is taken, the Photographer is not liable for loss, damage, or corruption of digital files due to technical failure beyond reasonable control.

Liability in such cases is limited in accordance with Clause 17.


17. Limitation of Liability

To the maximum extent permitted by law:

The Photographer is not liable for any indirect, incidental, or consequential loss or damage.

The Photographer’s liability is limited to:

Re-supplying the services; or

Refunding the amount paid

Nothing in these Terms excludes rights under the Australian Consumer Law.


18. Force Majeure

The Photographer is not liable for failure or delay in performing obligations due to events beyond reasonable control, including but not limited to:

Weather conditions

Illness or injury

Equipment failure

Natural disasters

Government restrictions


19. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes shall be subject to the jurisdiction of Queensland courts.


20. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.



21. Amendments

These Terms & Conditions may be updated at any time. The version in effect at the time of booking will apply.
